Monarch Windows & Doors Terms of Service

These Terms of Service (“Terms”) govern your use of monarch-windows.com (the “Site”), operated by Monarch Windows & Doors, 1352 Sharon Copley Rd., Wadsworth, Ohio 44281. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. What This Site Is

The Site provides information about our replacement window, entry door, patio door, garage door, and egress and exit products and services, and allows you to request a free consultation. The Site is informational. Using it does not create a contract for work.

2. Estimates, Quotes, and Pricing

• Nothing on the Site is a binding offer or a guaranteed price.
• Any price, promotion, or financing term described on the Site is subject to change, availability, credit approval where applicable, and the terms of the specific written proposal we give you.
• A binding agreement is formed only when you and Monarch sign a written proposal or contract for a specific scope of work. That signed document controls if it conflicts with anything on the Site.
• Product images, samples, and renderings are representative. Actual color, grain, finish, and hardware may vary.

3. Consultations

Consultations are free and carry no obligation. We may need access to the interior and exterior of your home to measure accurately. Scheduling is subject to availability and weather.

4. Your Submissions

When you submit a form, you agree that the information you provide is accurate and that you are the owner or authorized user of the phone number and email address you give us. Do not submit anyone else’s contact information without their permission. Do not submit sensitive information such as Social Security numbers, financial account details, or health information through the Site.

5. Communications Consent

By submitting a form, you agree that we may contact you about your inquiry by phone, email, and text message. Marketing text messages require the separate consent described on our forms and in our SMS Terms & Messaging Policy. Consent to marketing messages is not a condition of purchase. You may opt out at any time by replying STOP.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose
• Submit false, misleading, or automated form submissions
• Attempt to gain unauthorized access to the Site, its servers, or related systems
• Scrape, harvest, or copy Site content for commercial use without our written permission
• Introduce malware or interfere with the operation of the Site

7. Intellectual Property

The Site and its contents, including text, photographs, graphics, layout, and the Monarch Windows & Doors name and logo, are owned by Monarch or its licensors and are protected by copyright and trademark law. Manufacturer names and marks appearing on the Site, including ProVia, belong to their respective owners and are used to describe the products we sell and install. You may view and print pages for your personal, non-commercial use.

8. Third-Party Links and Content

The Site may link to or embed third-party websites and content. We do not control those services and are not responsible for their content, products, or privacy practices.

9. Disclaimer of Warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Monarch disclaims all warranties regarding the Site, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

This section applies to the website only. It does not limit, waive, or modify any product warranty, workmanship warranty, or manufacturer warranty provided in your signed contract or in writing by us or by a manufacturer.

10. Limitation of Liability

To the fullest extent permitted by Ohio law, Monarch Windows & Doors and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, and our total liability arising out of your use of the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, personal injury, or death caused by negligence.

11. Indemnification

You agree to indemnify and hold harmless Monarch Windows & Doors from claims and expenses arising out of your misuse of the Site or your breach of these Terms.

12. Privacy

Our Privacy Policy, Cookie Policy, and SMS Terms & Messaging Policy are incorporated into these Terms by reference.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Medina County, Ohio, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept them.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
